oBike流落偏鄉 縣府：通報就處理 | 基宜花東 | 地方 | 聯合新聞網
台東常見有oBike停放閒置在偏鄉，甚至是離島，這些流落偏遠地區的自行車，台東政府表示，只要民眾通報就請廠商移除。 記者尤聰光／攝影 分享 facebook 因應無樁式共享自行車oBike總公司停止營運，不比價撿便宜省錢王少引進縣市將這些無人管理的車輛當廢鐵拖吊移除，2017年4月引進上路的台東縣，雖自行車數量少，但地理環境幅員遼闊，車輛分布較廣，造成縣府後續處理的困擾。台東縣政府表示，目前仍在台東縣境內的oBike數量，初估不到300台，市區已較少見，大多分布在縱谷及東海岸線的觀光景點，因台東地理遼闊，常見有oBike本周限時購買折扣停放閒置在偏鄉，甚至是離島，對這些流落偏遠地區的自行車，將設法請廠商自行處理。. } }); } 縣府強調，oBike在台東仍有連絡窗口，民眾通報縣府1999專線，就會請廠商移除，廠商7天內沒有逕行處理，就會請當地鄉鎮公所視為棄置車輛移除。「該整頓還是要整頓！」陳姓市民表示，oBike雖在台東觀光發展上有助益，但是亂象層出不窮，尤其是承租人公德心薄弱，自行車隨處擺放，熱銷商品超實用且廠商回收處理消極，管理欠佳，期盼公部門能夠拿出魄力搶購限時商品整頓。

 桂宏誠觀點：亂套德國轉型正義─沒制憲前也違反自由民主憲政秩序

「促轉會」首度公布1270 位獲撤銷原判決的政治受難者名單，並將移請諸如國防部或司法院等機關塗銷有罪判決的前科紀錄。促轉會固然是依據《促進轉型正義條例》的規定做成決定，但該條例的邏輯是：因為在威權統治時代，就會有政治迫害，雖有司法審判必也不公。然而，因司法不公造成「冤錯假案」的政治迫害，「正義」的做法應先由法官重新審判而撤銷原判決，再另由法官重新依法審判作成新的判決，否則就涉及行政權侵害司法權而屬違憲。

首度由促轉會「平反」的「受難者」，包括日據時代曾在日本陸軍服務，二二八事件中擔任「二七」武裝部隊部隊長的鍾逸人，以及參與共黨組織或參加共黨在臺秘密武裝訓練的吳聲潤和李石城等，他們並未「否認」當時反對和著手實施「顛覆中華民國政府」的行為。如今未經法官依據法律重新審判，即逕而撤銷原判決，此除了是政治決定凌駕法院判決外，更全盤否定了威權統治時期的法治體系。

然而，哪些事情值得追求「轉型正義」？依據《促進轉型正義條例》第1條第2項規定：「威權統治時期違反自由民主憲政秩序之不法行為與結果，其轉型正義相關處理事宜，依本條例規劃、推動之」，亦即指在「威權統治時期」所發生一切違反「自由民主憲政秩序」的不法行為與結果。姑且不論該規定是否意味「威權統治時期」亦存在著「自由民主憲政秩序」？問題是上開規定所稱之「自由民主憲政秩序」，究係依據哪一部憲法及相關的法制體系？

1918年第一世界大戰德意志帝國戰敗，皇帝威廉二世因此被推翻退位，德國第一次走向了共和，並在1919年制定第一部自由民主體制的「威瑪憲法」。憲法學者對「威瑪憲法」的內容評價甚高，但納粹黨和希特勒於1933年依威碼憲法的民主程序取得政權後，實施種族主義和特務統治的極權獨裁體制，威瑪憲法自此已名存實亡。

二次大戰後西德制定基本法時，鑒於納粹以民主程序毀滅了原已建立的自由民主憲政體制，故強調自由民主憲政秩序的捍衛。同時，也正因納粹經由民主程序取得政權後，卻質變成民粹而破壞威瑪憲法，德國才有追究違反自由民主憲政秩序之責任的「轉型正義」。

促轉會首度平反的一千多位的「政治受難者」中，相信有些被槍決者已名列臺北馬場町，成為該處碑文上所稱1950年代「為追求社會正義及政治改革之熱血志士」。只不過，這些被槍決的「熱血志士」中絕大多數，卻又名列北京西山無名英雄廣場的「潛伏在臺罹難烈士」。弔詭的是，這些同時具「受難者」和「烈士」雙重身分者均係遭國民黨「迫害」，但前者面對後代是「沉冤昭雪」，後者卻是「光榮犧牲」。（推薦閱讀：蘇南觀點：如何以民主法治保障促轉會不淪落東廠？）
